  'One hour too much': Maxi employee stabbed while doing overtime, jury hears Clémence Beaulieu-Patry was killed by a man she barely knew, the jury hearing the murder trial of Randy Tshilumba was told on Friday. In her opening statement to the jury, prosecutor Catherine Perreault characterized the April 2016 homicide as one that came out of nowhere as far as the victim was concerned.The victim and the accused attended the same high school but were not friends, the jury was told. Beaulieu-Patry worked as a cashier at the Maxi supermarket where she was stabbed, but wasn’t originally scheduled to be there at the time. She had agreed with a manager’s request to do an hour of overtime.

DNA from aggravated sexual assault suspect Andy Dick Ntunaguza was found on his alleged victim, a jury heard Tuesday.

Reading from a statement of agreed facts, Crown prosecutor Deven Singhal told jurors Ntunaguza’s semen was found on the private parts of the woman he’s accused of raping.

Singhal read in the statement moments after his opening address to a two-woman, 10-man Calgary Court of Queen’s Bench jury.

In it, the prosecutor outlined the evidence he expects to call in the scheduled two-week trial.

Singhal told jurors the complainant, a woman in her 40s, “has been homeless for most of her life.”

DNA found on a rape victim' s clothes matched that of Antoni Imiela, a jury at Maidstone Crown Court heard today. It was discovered on the 26-year-old woman ' s top and bra she was wearing at the time of the attack in August 2002.

He also said she suffers both lupus and rheumatism.

In the early morning hours of Dec. 20, 2015, she was in the Bow Parkade in downtown Calgary.

“(She) was the victim of a savage sexual assault … that resulted in her being hospitalized,” Singhal said.

“Both of her eyes (were) swollen shut,” he said.

She also had cuts and scrapes all over her body including “deep abrasions and bruising” to her genitals.

The woman attempted to escape, but was prevented from doing so, the prosecutor told jurors.

“When she called for help she was restrained, held, choked by the neck,” he said.

Singhal said the attack occurred around 3:30 a.m.

Shortly after the incident a security officer found the woman.

“She was naked from the waist down and bleeding from her face,” he said.

She was taken to Foothills Medical Centre where swabs were taken and sent for analysis.

“The DNA recovered from those swabs matches the accused, Andy Dick Ntunaguza,” Singhal said.

Surveillance video from the 6th Avenue S.W. parkade was seized by police.

“Video … that I say depicts the accused leaving that parkade at approximately the same time (the complainant) was being discovered by security.”

According to the agreed facts she was found there at 3;43 a.m.

“She stated that she had been sexually assaulted and was subsequently transported to the Foothills hospital,” Singhal said, reading from the agreed statement.

Video surveillance from nine cameras from the south stairwell at the Bow Parkade, which will be played for jurors during the trial, shows the area between 3:30 and 3:50 a.m.

Video from a nearby CTrain platform will also be shown during the trial, Singhal said.

At Singhal’s request, Justice Adam Germaine reiterated a publication ban on the identity of the woman.

Ntunaguza, 32, has pleaded not guilty.
