A defence lawyer suggested to a woman that when she was nine years old, she falsely accused her foster father of sexual abuse in order to get her and her brother out of the home.

Brad Mitchell said she continued to lie about it years later, after she was removed from the home, because her brother was left behind.

“I disagree,” testified the now 21-year-old woman, whose identity is protected by a publication ban.

She was cross-examined on Tuesday at the trial of her former foster father, who is charged with sexual assault and sexual interference against her between 2000 and 2005, while they lived on an acreage near Humboldt.

The former foster mother testified the girl told her about being touched on a couch, but didn’t say where or how.

“I didn’t know what to think,” she said when Crown prosecutor Tamara Rock asked what the girl meant by “touching.”

She said she took the girl to confront her husband, who said he had no idea what she was talking about.

Taking the stand to testify in his own defence after the Crown closed its case on Tuesday, the accused said he remembers that the girl didn’t answer him when he asked her where he supposedly touched her. The man told court he was rarely alone with the girl and denied having any sexual contact with her.

The complainant said the abuse happened on a couch while her brother was home. Mitchell noted it would have been in an open space where her brother could see, but the complainant said he would often have been playing in his room.

Jurors heard the couple ensured the girl and her foster father were never alone together after the allegations were made. The wife said she couldn’t remember if she reported it to social services staff. She said she believed there was an investigation, but nothing came of it.

A social worker testified the girl was removed from the home when she was 14 because of substantiated physical abuse. The couple said it was because of a fight over stolen keys found in the girl’s room.

Mitchell asked the complainant why she didn’t tell authorities about the abuse after leaving the home, despite having several opportunities. She said she was scared and started using drugs to cope.

She said she also stayed quiet during the five years she was being abused because her foster father told her to keep it a secret. During cross-examination, she said her foster mother made her feel ashamed when she finally had the courage to come forward, so she never brought it up again over the next five years she continued living with the couple.
